AN ORDINANCE TO AMEND ORDINANCE 6-30 CLARIFYING REQUIREMENTS TO GET A NEW OR CHANGING ALCOHOL PERMIT ON THE COUNCIL AGENDA

WHEREAS, the City of Jonesboro has established rules for the approval of a private club permit, transfer of business location, and/or change in business operation for private clubs in the city limits; and

WHEREAS, the City of Jonesboro wishes to clarify the process for getting these applications on the council agenda.

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JONESBORO, ARKANSAS:

SECTION ONE:  That Ordinance 6-309(d) shall be repealed and replaced with the following language:

“Once the completed application has been approved by the police department and the planning department, the applicant will be notified to request that the city clerk place the application on the city council agenda for consideration. In addition to the approved application, applicants must submit an ordinance containing the request to approve a new alcohol permit, the request to transfer location, or the request to change the type of business of an existing permit to the city clerk to be considered by city council prior to the item being placed on the council agenda.  If applicant does not submit the verified application, publications fees, and ordinance to the council for approval within 60 days of the application being verified, it shall be deemed denied.  If an application is denied for lack of action by applicant, the applicant must wait six months before submitting another application.”

SECTION TWO:  Any sections of the City of Jonesboro Code of Ordinances that conflict with these changes are hereby repealed to the extent of such conflict.
