A RESOLUTION OF THE CITY OF JONESBORO, ARKANSAS TO ENTER INTO AN AGREEMENT WITH THE ARKANSAS DEPARTMENT OF TRANSPORTATION (ARDOT) FOR MODIFICATION TO THE CITY OF JONESBORO RAIL CROSSING (DOT #917584G) AT HWY. 18 SPUR MARTIN LUTHER KING JR. DRIVE WIDENING PROJECT (JOB 100657)

WHEREAS, the Arkansas Department of Transportation (ARDOT) is preparing plans to widen Hwy. 18 Spur Martin Luther King Jr. (MLK) Drive to five lanes; and,
WHEREAS, this roadway widening project will require modifications to the city-owned at-grad railroad crossing (DOT #917584G) along MLK Drive; and,
WHEREAS, ARDOT agrees to reimburse the City of Jonesboro for all expenses and actual costs incurred for this rail modification work; and,
WHEREAS, an agreement for reimbursement of Preliminary Engineering (PE) services related to this rail modification is attached; and,
WHEREAS, Supplemental Agreements for engineering design and construction related services are expected.
NOW, THEREFORE BE IT RESOLVED, BY THE CITY COUNCIL OF THE CITY OF JONESBORO, ARKANSAS;
Section 1. That the City of Jonesboro agrees to collaborate with ARDOT and modify the City of Jonesboro rail crossing at Hwy. 18 Spur (DOT #917584G) Martin Luther King Jr. Drive to accommodate the five lane roadway project.
Section 2. The City of Jonesboro shall be reimbursed by ARDOT for all expenses and actual costs incurred for this project in accordance with the attached PE Agreement and any other Supplemental Agreements.
Section 3. The Mayor and the City Clerk are hereby authorized by the City Council for the City of Jonesboro to execute all documents necessary to effectuate this PE Agreement, and any Supplemental Agreements to facilitate this work.
