AN ORDINANCE TO WAIVE BIDS AND PURCHASE TWO SANITATION TRUCKS FOR THE SANITATION DEPARTMENT

WHEREAS, the Sanitation Department is in need of two additional rear load trucks to address the collection of yard waste during the fall and winter season; and,
WHEREAS, the price for the purchase of two used rear load trucks from River City Hydraulics is $262,500.
NOW, THEREFORE BE IT ORDAINED by the City Council for the City of Jonesboro, Arkansas that:
Section 1: The Mayor and City Clerk may execute agreements to purchase the two trucks.
Section 2: The monies for this purchase shall be transferred from the general fund reserves to the fund for sanitation residential fixed assets.
Section 3: That the City Council, in accord with the terms of A.C.A. Section 14-58-303, states that bidding in this matter is not practical and this is considered a sole source since there are no other used trucks of this type available in the area and hereby waives the requirement of competitive bidding.
Section 4: It is further found that due to the potential for flooding from excessive leaf bags or leaves from broken bags that stop up storm drains, an emergency is declared to exist, and this ordinance being necessary for the preservation of the public peace, health, and safety, it shall take effect from and after passage and approval.
