AN ORDINANCE TO AMEND CHAPTER 26-21 TO ALLOW THE MAYOR TO DECLARE AN EMERGENCY CURFEW PURSUANT TO STATE LAW AND TO REMOVE THE REQUIREMENT OF CITY COUNCIL VOTE TO EXTEND WITHIN 48 HOURS

WHEREAS, the City passed Ordinance 26-21 to establish the Mayor’s ability to declare an emergency curfew for the City, or portions of the City, and requiring Council approval to extend said curfew past 48 hours from the time of issue, and;

WHEREAS, the Council acknowledges that in most emergency situations it is impracticable to convene a council meeting within 48 hours to meet these requirements, and;

WHEREAS, the City Council of the City of Jonesboro, Arkansas has determined that it is in the best interest of the citizens of the city to amend Chapter 26-21 to remove the requirement that City Council approve the extension of a curfew called for by the Mayor within 48 hours. 

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JONESBORO, ARKANSAS:

SECTION ONE:  And shall now allow the Mayor to place an emergency curfew in effect pursuant to state law for no longer than 120 days or until the next regularly scheduled city council meeting.

SECTION TWO:  That the City Council specifically declares that the requirements as set out in state law shall control in all situations regarding the declaring of an emergency curfew. 

SECTION THREE:  That any ordinances which may conflict with this ordinance are hereby repealed.

SECTION FOUR:   It is further found that due to local, state, and federal declarations of emergency regarding COVID 19 and the constantly changing directives from the Center for Disease Control, that this ordinance is necessary for the preservation of the public peace, health, and safety, and an emergency is declared to exist and this ordinance shall take effect from and after its passage and approval.
