AN ORDINANCE TO WAIVE COMPETITIVE BIDDING AND PURCHASE BRIDGE PANELS FOR THE REPLACEMENT OF THE HESTER STREET BRIDGE BY THE STREET DEPARTMENT, AND DECLARING AN EMERGENCY

WHEREAS, the City of Jonesboro, Arkansas, is in need of bridge panels and hardware for the Street Department to replace the Hester Street Bridge; and,
WHEREAS, there is only one known source for the panels required including the hardware; and,
WHEREAS, the price for the purchase from Forterra Pipe & Precast is a cost of $65,249.00 plus sales tax.
NOW THEREFORE BE IT ORDAINED by the City Council for the City of Jonesboro that:
Section 1: The City Council finds there is only one source for this product and hereby waives competitive bidding and authorizes the Mayor to purchase said panels and hardware.
Section 2: The City Council further finds that due to the immediate need to replace the Hester Street Bridge which is deteriorating, and the time required to acquire these panels and hardware from the manufacturer, an emergency is declared to exist and this ordinance being necessary for the preservation of the public health and safety, it shall take effect from and after its passage and approval.
