A RESOLUTION TO THE CITY OF JONESBORO, ARKANSAS TO ENTER INTO A TRI-PARTY CONTRUCTION AND MAINTENANCE AGREEMENT WITH THE ARKANSAS STATE HIGHWAY AND TRANSPORTATION DEPARTMENT AND BNSF RAILWAY FOR THE BNSF RAILROAD OVERPASS (HWY 18) - JOB NO. 100824

WHEREAS, the Arkansas Highway and Transportation Department will construct on overpass structure that will cross over Railroad right of way and tracks on Watt Street located in the City of Jonesboro;

 

WHEREAS, the City of Jonesboro desires to enter into a tri-party Construction and Maintenance agreement with Arkansas State Highway Transportation Department, and BNSF Railway in regards to the Watt Street Overpass;

 

WHEREAS, the Construction and Maintenance agreement covers the construction, ownership, use, maintenance and repair of the BNSF Railroad Overpass at Watt Street.

 

NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL FOR THE CITY OF JONESBORO, ARKANSAS THAT:

 

Section 1:  That the City of Jonesboro shall enter into a tri-party Construction and Maintenance agreement with Arkansas State Highway Transportation Department, and BNSF Railway in regards to the Watt Street Overpass;

 

Section 2:  The Mayor and the City Clerk are hereby authorized by the City Council for the City of Jonesboro to execute all documents necessary to effectuate this agreement.
