AN ORDINANCE TO AMEND THE JONESBORO CODE OF ORDINANCES SEC. 117-2 AND SEC. 117-107 TO DEFINE AND PROVIDE ZONING CLASSIFICATIONS FOR PHARMACIES, MEDICAL MARIJUANA DISPENSARIES AND MEDICAL MARIJUANA CULTIVATION CENTERS

WHEREAS, the State of Arkansas through a vote of the citizens of the state approved the use of medical marijuana; and
WHEREAS, the City of Jonesboro wishes to amend its Code of Ordinances in order to be in compliance with the requirements of state law.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JONESBORO, ARKANSAS:
SECTION ONE: That the Jonesboro Code of Ordinances Sec. 117-2 shall be amended to add the following definitions:
Pharmacy means a place where medicines are compounded or dispensed.
Medical Marijuana Cultivation Center means an entity that has been licensed by the Arkansas Medical Marijuana Commission to cultivate, prepare, manufacture, process, package, sell, and/or deliver to a dispensary.
Medical Marijuana Dispensary means an entity that has been licensed by the Arkansas Medical Marijuana Commission to dispense medical marijuana.
SECTION TWO: That the Jonesboro Code of Ordinances Sec. 117-107 shall be amended to add Pharmacy and Medical Marijuana Dispensary to the Use Table for Commercial and Industrial Uses as a permitted use in C-3.
SECTION THREE: That the Jonesboro Code of Ordinances Sec. 117-107 shall be amended to add Pharmacy and Medical Marijuana Cultivation Center to the Use Table for Commercial and Industrial Uses as a permitted use in I-1 and I-2.
