AN ORDINANCE TO AMEND ORDINANCE 46-70 TO EXEMPT CITY APPROVED SHOOTING RANGES FROM THE LOUD NOISE ORDINANCE

BE IT ORDAINED by the City Council for the City of Jonesboro, Arkansas that:
WHEREAS, growth within the City of Jonesboro has led to the opportunity to have both publicly and privately owned shooting ranges locate to the City. The very use and nature of these ranges will create noise within the City. The council and planning commission are cognizant of this when determining the best fit for the location of said facilities and all possible consideration is given to neighboring homes and/or businesses at the time these ranges are approved.
WHEREAS, the City Council of the City of Jonesboro, Arkansas has determined that it is in the best interest of the citizens of the City to amend the ordinance on loud noises in the City of Jonesboro to exempt any approved shooting ranges from Ordinance 46-70.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JONESBORO, ARKANSAS:
SECTION ONE: That Ordinance 46-70 shall hereby be amended to add the following section:
(d) That none of the terms or prohibitions of this ordinance shall apply to or be enforced against any noise resulting from the normal operation of a public or privately owned shooting range facility which has been approved by the City of Jonesboro. A range is in compliance with this ordinance when operated in accordance with the terms of the City’s approval and any required permits. The intent of this provision is that normal operation of approved ranges will qualify for the immunity from nuisance and noise pollution suits as provided by Ark Code Ann. § 16-105-502.
