AN ORDINANCE TO THE CITY OF JONESBORO, ARKANSAS TO AMEND THE 2016 BUDGET, ACCEPT THE LOW BID AND ISSUE A PURCHASE ORDER TO KINDER BROTHER EXCAVATING, INC. FOR RECHANNELING/MODIFYING DRAINAGE CHANNELS (2016:28); AND DECLARING AN EMERGENCY

WHEREAS, the City of Jonesboro passed the 2016 Budget in Ordinance Number 15:069, which will need to be amended to transfer funds from the Reserves to the Capital Improvement - Drainage budget in order to effectuate the acceptance of the low bid and issuing a purchase order for the rechanneling/modifying of drainage channels.
WHEREAS, the City of Jonesboro has desires to accept the low bid and issue a purchase order for the rechanneling/modifying of drainage channels to Kinder Brothers Excavating, Inc.
WHEREAS, funding for the execution of the purchase order shall come from funds allocated from the Reserves to the Capital Improvements - Drainage budget and compensation shall be paid in accordance with the bid documents.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JONESBORO, ARKANSAS THAT:
SECTION 1: The 2016 Budget is hereby amended to increase in the Captial Improvements - Drainage budget by transferring money from the Reserves for the rechanneling/modifying of drainage channels.
SECTION 2: That the City of Jonesboro shall accept the low bid and issue a purchase order to Kinder Brothers Excavating, Inc. for the rechanneling/modifying of drainage channels.
SECTION 3: The City Council further finds and declares that an emergency exist and this Ordinance being necessary for the preservation of the public peace, health, and safety, this Ordinance shall take effect and be in full force and effect from and after its passage and approval.
