AN ORDINANCE TO WAIVE COMPETITIVE BIDDING AND AUTHORIZE PURCHASE OF A BLOWER FAN FOR THE CITY INCINERATOR FOR THE SANITATION DEPARTMENT

WHEREAS, the City Incinerator utilized to burn yard waste has been rendered inoperable due to the loss of the main blower for the system; and
WHEREAS, the City of Jonesboro does not have the storage capacity for yard waste and needs an operational incinerator to remain compliant with state and federal requirements; and
WHEREAS, the City of Jonesboro contacted vendors in an effort to repair the equipment as quickly as possible due to the increased demand during this season; and
WHEREAS, RBG Mechanical Contractors Inc. provided pricing for the equipment and installation of the blower fan in the amount of $29,805.00 plus tax.
NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF JONESBORO, ARKANSAS THAT:
SECTION 1: The Sanitation Department of the City of Jonesboro, Arkansas needs to purchase a 75 HP Blower Fan for the Yard Waste Incinerator
SECTION 2: The equipment may be purchased from RGB Mechanical Contractors, Inc. of Jonesboro, Arkansas for $29, 805.00 plus tax.
SECTION 3: The 2021 Adopted Budget for the City of Jonesboro includes funding for this purchase.
SECTION 4: The City Council in accordance with the terms of A.C.A. Section 14-58-302 hereby waive the requirement of competitive bidding and direct the purchasing agent to purchase the above described for the price set forth in section 2 above.
SECTION 5: It is further found that due to immediate need to acquire this equipment to replace existing equipment for yard waste disposal, an emergency is declared to exist and this ordinance being necessary for the preservation of the public peace, health, and safety, it shall take effect from and after passage and approval.
