AN ORDINANCE ABANDONING AND VACATING AN ALLEY LOCATED IN THE 1000 BLOCK OF BURKE STREET AS REQUESTED BY STEVEN CHAPLAIN

WHEREAS, a petition was duly filed with the City Council of the City of Jonesboro, Arkansas on the 18th day of December 2018, praying the City Council to vacate and abandon the alley described as Point of beginning; The southwest corner of Lot 12 of the Gregg and Houghton’s Subdivision of block 13 Of the Nisbett’s Second Addition of the City of Jonesboro, Arkansas as recorded in Deed Record 23, Page 434, the office of the Circuit Clerk and Ex-Officio Recorder; thence easterly direction to the southeast corner of Lot 8 of the Gregg and Houghton’s Subdivision of block 13 of the Nisbett’s Second Addition, thence south 10 feet to the northeast corner of Lot 6, of the Gregg and Houghton’s Subdivison of block 13 of the Nisbett’s Second Addition, thence westernly direction to the northwest corner of Lot 7, of the Gregg and Houghton’s Subdivison of block 13 of the Nisbett’s Second Addition, thence north 10 feet to the point of beginning of the southwest corner of Lot 12 of the Gregg and Houghton’s Subdivison of block 13 of the Nisbett’s Second Addition of the City of Jonesboro, Arkansas.

WHEREAS, after due notice as required by law, the City Council has at the time and place mentioned in the notice, heard all persons desiring to be heard  on the question and has ascertained that the alley heretofore described has heretofore been dedicated to the public use as an alley; that it has never actually been developed or used by the public for many years;that the owners of all the property abutting upon the alley to be vacated have filed with the City Council their written consent to such abandonment; and that the public interest and welfare will not be adversely affected by the abandonment of such alley.

NOW, THEREFORE, be it ordained by the City Council of Jonesboro, Arkansas:

Section 1. The City of Jonesboro, Arkansas, hereby releases, vacates and abandons all its rights together with the rights of the public generally in and to the alley described as follows:

Point of beginning; The southwest corner of Lot 12 of the Gregg and Houghton’s Subdivision of block 13 of the Nisbett’s Second Addition of the City of Jonesboro, Arkansas as recorded in Deed Record 23, Page 434, the office of the Circuit Clerk and Ex-Officio Recorder; thence easterly direction to the southeast corner of Lot 8 of the Gregg and Houghton’s Subdivision of block 13 of the Nisbett’s Second Adsition, thence south 10 feet to the northeast corner of Lot 6, of the Gregg and Houghton’s Subdivison of block 13 of the Nisbett’s Second Addition, thence westernly direction to the northwest corner of Lot 7, of the Gregg and Houghton’s Subdivison of block 13 of the Nisbett’s Second Addition, thence north 10 feet to the point of beginning of the southwest corner of Lot 12 of the Gregg and Houghton’s Subdivison of block 13 of the Nisbett’s Second Addition of the City of Jonesboro,Arkansas.

Section 2. A copy of the Ordinance duly certified by the City Clerk shall be filed in the office of the Recorder of the Jonesboro District of Craighead County and recorded in the deed record of said county.

Section 3. This ordinance shall take effect and be in force from and after its passage.
