LEGAL DESCRIPTION - EASEMENT ABANDONMENT:
A part of Lot 2, Red Wolf corner Replat of Lots 1 - 10, Block 'B' of Fairview Acres, Jonesboro, Craighead County, Arkansas, being more particularly described as follows:
From the Northwest corner of said Lot 2, run S89°21'29"E a distance of 81.56 ft. to the POINT OF BEGINNING; thence continue S89°21'29"E a distance of 28.20 ft. to a point; thence S00°43'04"W a distance of 20.32 ft. to a point; thence S87°34'03"E a distance of 28.59 ft. to a point; thence N65°24'02"E a distance of 2.59 ft. to a point; thence S24°35'58"E a distance of 5.64 ft. to a point; thence S35°56'52"E a distance of 97.49 ft. to a point; thence S26°26'21"E a distance of 29.42 ft. to a point; thence along a curve to the right, said curve having a radius of 580.11 ft., an arc of 30.45 ft., a chord length of 30.45 ft. and a chord bearing of S73°43'21"W to a point; thence N24°35'58"W a distance of 68.77 ft. to a point; thence N35°56'52"W a distance of 44.06 ft. to a point; thence N87°34'03"W a distance of 9.35 ft. to a point; thence S65°24'02"W a distance of 11.94 ft. to a point; thence S00°43'04"W a distance of 108.34 ft. to a point; thence along a curve, said curve having a radius of 580.11 ft., an arc of 35.01 ft., a chord length of 35.00 ft. and a chord bearing of S84°36'39"W to a point; thence N82°06'21"W a distance of 12.65 ft. to a point; thence N86°51'52"E a distance of 18.67 ft. to a point; thence N00°54'51"E a distance of 154.95 ft. to a point, said point being the POINT OF BEGINNING.
WHEREAS, the City Council at its regular meeting on December 4, 2018, pursuant to Ark. Stats. Section 14-301-302 through 14-301-304 heard the request of the Northeast Border, LLC, being private owners, to abandon utility easements; and
WHEREAS, the City Council held a public hearing and heard all persons desiring to be heard in connection with this matter; and
WHEREAS, the respective utilities have consented to said abandonment; and
WHEREAS, the abandonment of said utility easements will not adversely affect the City of Jonesboro, and would be in the best interest of all parties concerned.
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas, that;
SECTION 1. The City of Jonesboro, Arkansas hereby vacates and abandons all of its rights together with the right of the public generally, in and to the utility easements described above.
SECTION 2. A copy of this Ordinance duly certified by the City Clerk shall be filed in the office of the Recorder of Craighead County at Jonesboro, Arkansas, and recorded in the Deed Records of Craighead County, Arkansas.
SECTION 3. The closing, vacating and abandonment by the City of its rights and the rights of the public generally in the above described utility easements are in the public interest and will promote the public peace and welfare.
