Title

AN ORDINANCE TO WAIVE COMPETITIVE BIDDING AND APPROVE THE PURCHASE OF A CASE TRACTOR FOR THE STREET DEPARTMENT, APPROPRIATING FUNDS, AND DECLARING AN EMERGENCY

Body

WHEREAS, the existing 2011 Case 125 tractor with mower attachment in the Street Department is in need of repair; and

 

WHEREAS, the repairs for the tractor will cost $20,833, and carry a 90 day warranty; and

 

WHEREAS, the Street Department spent $18,843 in the previous year and recommends purchasing a new tractor in lieu or repairing due to cost; and

 

WHEREAS, the Street Department of the City of Jonesboro recommends purchasing a 2016 Case 125 PS tractor, SN ZGEE05262, and

 

WHEREAS, said tractor may be purchased from Heartland Equipment, 1701 E. Parker Rd, Jonesboro, AR 72404 for the sum of $81,000.00, and

 

WHEREAS, the price includes the installation of an Alamo mower, owned by the City, onto said tractor, and

 

WHEREAS, the purchase price includes the trade in of a 2011 Case 125 tractor, SN ZBBE03011, in the amount of $10,000.

 

NOW THEREFORE BE IT ORDAINED by the City Council for the City of Jonesboro, Arkansas that:

SECTION ONE:  That the City Council in accordance with the terms of A.C.A.  Section 14-58-302 hereby waives the requirement of competitive bidding deeming it unfeasible to bid due to the following: (1) The tractor is torn apart and it would cost additional money to have the tractor reassembled for trade-in; (2) Heartland is willing to take the tractor for trade in; (3) The mower attachment is Case International brand and will only fit on a Case International tractor; (4) Time constraints make it impractical to bid. The City Council directs the Purchasing Agent to purchase the above described equipment for the price set forth above with trade-in.

 

SECTION TWO: There is hereby appropriated the sum of $81,000.00 from the unappropriated balance in the Street fund for the purchase of the Case tractor.

 

SECTION THREE:   It is further found that due to immediate need to acquire this equipment to replace existing equipment for mowing right of ways, an emergency is declared to exist and this ordinance being necessary to keep up maintenance on right of ways and for the preservation of the public peace, health and safety, it shall take effect from and after its passage and approval.
