AN ORDINANCE TO WAIVE BIDDING REQUIREMENTS FOR THE PURCHASE OF A 2007 CATERPILLAR TRACK TYPE TRACTOR (DOZER)

BE IT ORDAINED by the City Council for the City of Jonesboro, Arkansas that:

 

SECTION ONE:  That the City of Jonesboro Street Department needs to purchase a 2007 Caterpillar D5GLGPA Track Type Tractor (Dozer), S/N ORKG03433.

 

SECTION TWO:  That said equipment can be obtained from J.A. RIGGS, 3701 E PARKER RD, JONESBORO AR  72401 at a price of $80,684.38.

 

SECTION THREE:  That guaranteed purchase price of said equipment is $120,048.38; that said equipment has been leased by the Street Department since August, 2007, and price in SECTION TWO above reflects eleven months rental paid to vendor in the amount of $48,510.00 plus a finance charge of $9,146.00.

 

SECTION FOUR:  That said 2007 CATERPILLAR D5GLGPA DOZER best meets the needs of the Street Department and the Public Works Committee recommends the purchase of said dozer.

 

SECTION FIVE:  That money for the purchase of said dozer shall be appropriated from the Street Department Fixed Asset account 02-100-0232-00.

 

SECTION SIX:  That the City Council in accord with the terms of A.C.A. Section 14-58-302 hereby waives the requirement of competitive bidding and directs the Purchasing Officer to purchase the above described services for the price set forth in Section Two above.

 

SECTION SEVEN:  It is further found that due to the immediate need to acquire these services an emergency is declared to exist and this ordinance being necessary for the preservation of the public peace, health, and safety shall take effect from and after its passage and approval.
