Title

AN ORDINANCE TO APPROVE RETIREMENT BENEFITS OF THE POSITION OF CITY ATTORNEY AS PROVIDED IN ARKANSAS CODE ANNOTATED § 24-12-120 AND FOR OTHER PURPOSES.

Body

WHEREAS, state law provides retirement benefits for Mayors and City Clerks of cities of the first class; and

 

WHEREAS, the City of Jonesboro provides retirement benefits for uniformed and non uniformed employees; and

 

WHEREAS, the City Attorney is the only full time elected position or full time employee not covered or provided with retirement benefits; and

 

WHEREAS, AC.A § 24-12-120 provides that upon approval by the governing body, a city of the first class may provide for retirement benefits established by AC.A § 24-12-120 for a city attorney elected or appointed to office; and

 

WHEREAS, the City Council of the City of Jonesboro finds that it is appropriate to provide retirement benefits for any City Attorney meeting the requirements of AC.A § 24-12-120;

 

NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas:

 

SECTION 1: As authorized by AC.A § 24-12-120, any city attorney who shall have served in office as city attorney for a period of not less than twenty (20) years shall be entitled to retire at an annual retirement benefit during the remainder of his or her natural live, payable at the rate of one-half (1/2) of the salary payable to the city attorney at the time of his or her retirement.  All Payments of retirement benefits under this section shall be payable monthly and shall be paid from the general funds of the city.

 

SECTION 2: All ordinances or parts of ordinances in conflict herewith are hereby repealed to the extent of such conflict.
