AN ORDINANCE ABANDONING A UTILITY EASEMENT RUNNING ALONG THE NORTH SIDE OF LOTS 1 AND 2 OF BROWNS LANDING ADDITION TO THE CITY OF JONESBORO, ARKANSAS.

WHEREAS, the City Council at its regular meeting on September 5, 1995, heard the request of John R. and Dorothy A. Robinson to abandon a 7-1/2 foot utility easement running along the North side of Lots 1 and 2 of Browns Landing Addition; and

WHEREAS, the City Council held a public hearing and heard all persons desiring to be heard in connection with this matter; and

WHEREAS, John R. and Dorothy A. Robinson plan to develop Lots 1 and 2 of Browns Landing Addition and replat it with adjacent property which makes it necessary to abandon said easement; and

WHEREAS, John R. and Dorothy A. Robinson have received approval from all utility companies for the abandonment of said easement; and

WHEREAS, the abandonment of said easement would not adversely affect any utility companies and would be in the best interest of all parties concerned.

NOW, THEREFORE, BE IT ORDAINED by the City Council for the City of Jonesboro, Arkansas, that:

SECTION 1: The City of Jonesboro, Arkansas, hereby vacates and abandons all of its rights together with the right of the public generally, in and to a 7-1/2 foot easement running along the North side of Lots 1 and 2 of Brown's Landing Addition to the City of Jonesboro.

SECTION 2: A copy of this ordinance duly certified by the City Clerk shall be filed in the office of the Recorder of Craighead County at Jonesboro, Arkansas, and recorded in the Deed Records of Craighead County, Arkansas.

SECTION 3: The closing, vacating and abandonment by the City of its rights and the rights of the public generally in the above described easement is in the public interest and will promote the public peace and welfare.
