ORDINANCE TO WAIVE BIDDING REQUIREMENTS FOR RADAR GUNS FROM KUSTOM ELECTRONICS, INC.

BE IT ENACTED BY THE CITY OF JONESBORO, ARKANSAS AN ORDINANCE TO WAIVE BIDDING REQUIREMENTS:
WHEREAS, the City of Jonesboro has three X-Brand radar guns, presently in service which can no longer be repaired and no new units purchased to replace them;
WHEREAS, the purchasing agent has talked with Kustom Electronics, Inc. and has learned that, it is the only dealer located in this geographical area which supplies comparable equipment. Said equipment is the K-Brand radar gun.
WHEREAS, the City of Jonesboro needs two such radar guns and since the above mentioned dealer is the only dealer in this area, it is more feasible to waive formal bidding procedures.
WHEREAS, the approximate cost of the two units will be $2,590.
NOW, THEREFORE, be it ordained by the City Council of the City of Jonesboro, Arkansas:
Section 1: State law section 2-3.3 of the Code of Ordinances of the City of Jonesboro, Arkansas should be waived to permit the City purchasing agent to purchase two K-Brand radar guns without formal bidding procedures.
Section 2: Due to the present need for two units an emergency is declared and this ordinance being necessary for the preservation of the public peace, health and safety shall be in full force and effect from and after its passage and approval.
