Title

AN ORDINANCE TO WAIVE FORMAL BIDDING AND AUTHORIZE THE PURCHASING OF FUEL FOR THE PUBLIC WORKS DEPARTMENT.

BE IT ORDAINED by the City Council for the City of Jonesboro, Arkansas that:

 

SECTION ONE:  That the Public Works Department of the City of Jonesboro, Arkansas needs to continue to purchase fuel from Vendors to supply the fuel tanks at the City Shop;

 

SECTION TWO:  That with the rising prices of fuel, tanker loads do not fall within City purchasing limits of $10,000 or State laws of $20,000 and under without formal bidding;

 

SECTION THREE: That buying fuel in bulk reduces the unit price and the overall cost of the fuel per gallon thus saving money to the City and having adequate supplies on hand for emergency purposes;

 

SECTION THREE:  That the City Council in accord with the terms of A.C.A.  Section 14-58-302 hereby waives the  requirement of formal bidding and directs the Purchasing Agent to purchase the above described using the normal purchasing procedures for purchases of $2,000 or more as set forth by the purchasing manual adopted by the council.

 

SECTION FOUR:   It is further found that due to immediate need to acquire this fuel in bulk, an emergency is declared to exist and this ordinance being necessary for the preservation of the public peace, health and safety, it shall take effect from and after its passage and approval.
