BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas, that:
 
SECTION 1: The City of Jonesboro, Arkansas, hereby releases, vacates and abandons all its rights, together with the rights of the public generally, in and to the utility easement designated as follows:
 
LEGAL DESCRIPTION
 
All of the south one hundred seventy one and 37/100 feet (171.37') of the utility easement seven and one half feet (7.5') in width along the east side of Lot 8 in Block D, Woodsprings Estates, Phase IV, Jonesboro, Arkansas as shown by plat recorded in Plat Cabinet B at Page 97 in the office of the Circuit Clerk for the Western District of Craighead County in Jonesboro, Arkansas.
 
SECTION 2: A copy of the ordinance certified by the City Clerk shall be filed in the office of the Recorder of Craighead County, Arkansas, and shall be filed in the Deed Records of such office.
 
SECTION 3: The City Council of the City of Jonesboro, Arkansas, finds and declares that the above utility easement is not necessary for the general benefit and welfare of the public; that the owners of all the property abutting the utility easement described above are in favor of the closure and vacation of said utility easement and that, therefore, an emergency is declared to exist and this ordinance shall take effect and be in full force from and after its passage and approval.
 
PASSED AND ADOPTED this 5th day of May, 1997.
