AN ORDINANCE DESIGNATING BROWN’S LANE FROM HIGHLAND DRIVE SOUTH TO HIGHWAY 63 BY-PASS AS AN ARTERIAL STREET AND ESTABLISHING RIGHT-OF-WAY

BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas:

 

Section 1: From and after passage and adoption of this Ordinance, Brown’s Lane from Highland Drive south to Highway 63 by-pass shall be designated as an arterial street and the right-of-way is hereby established at 100 feet.

 

Section 2: No building permits shall be issued and it shall be unlawful for any person or other owner of land bordering Brown’s Lane as described above to construct, erect, reconstruct or alter any building nearer or closer to such right-of-way line, which shall be the center line of the right-of-way of Brown’s Lane, prescribed by setback Ordinance.

 

Section 3: The right-of-way as designated by this Ordinance does not repeal any existing Ordinance except as may be specifically set out herein and Sections 20-1, 20-2, 20-81 and 20-82 shall remain in full force and effect and nothing in this Ordinance shall limit the effect of the Code sections set out herein.

 

Section 4: It is found and declared by the City Council that due to the fact that Brown’s Lane is the south segment of a proposed east arterial that would connect Highway 63 by-pass on the south and Johnson Avenue on the north and due to the fact that there is increased interest in all the area between the Highway 63 by-pass and Highland Drive and this Ordinance being necessary for the preservation of the public peace, health and safety, an emergency is hereby declared to exist and the Ordinance shall take effect from and after its passage and approval.
