AN ORDINANCE TO VACATE AND ABANDON STREETS KNOWN AS ROOSEVELT AVENUE AND CARAWAY AVENUE IN HIGHLAND PARK ADDITION, REPLATTED AS REPLAT OF RANCHETTE ACRES

WHEREAS, a petition was duly filed with the City Council of the City of Jonesboro, Arkansas on March 16, 1988, asking the City Council to vacate and abandon certain streets known as Roosevelt Avenue & Caraway Avenue shown on the replat of Highland Park Addition recorded in Deed Record 48, page 55, in the office of the recorder of Craighead County, Arkansas, and which is included within property which has been replatted as Ranchette Acres, Craighead County, Arkansas; and
WHEREAS, after due notice as required by law, the council has, at the time and place mentioned in the notice, heard all persons desiring to be heard on the question and has ascertained that the streets hereinbefore described have heretofore been dedicated to the public use as streets herein described; have not been actually used by the public generally for a period of at least five (5) years subsequent to the filing of the replat; that all the owners of the property abutting upon the portion of the streets to be vacated have filed with the council their written consent to the abandonment; and that public interest and welfare will not be adversely affected by the abandonment of the streets.
NOW, THEREFORE, BE IT ORDAINED by the City Council of Jonesboro, Arkansas, that:
SECTION 1: The City of Jonesboro, Arkansas, hereby releases, vacates and abandons all of its rights, together with the rights of the public generally, in and to the streets designated as follows:
That portion of property known as Roosevelt Avenue and Caraway Avenue which was dedicated to the public use as streets in Highland Park Addition which addition has been replatted as Replat of Ranchette Acres.
SECTION 2: A copy of the ordinance duly certified by the City Clerk shall be filed in the office of the recorder of Craighead County, Arkansas, and recorded in the...
