ORDINANCE DEFINING THE TERM “PROFESSIONAL SERVICES”, PROVIDING FOR THE ANNUAL NEGOTIATION OF CONTRACTS WHICH PROHIBITS THE USE OF COMPETITIVE BIDDING FOR THE PROCUREMENT OF PROFESSIONAL SERVICES

WHEREAS, Arkansas Code Annotated § 19-11-801 et seq requires any city of the first class to define what is considered “professional services” for the purpose of directing the contracting authority when negotiating applicable contracts; and

 

WHEREAS, the Jonesboro City Council desires to amend its existing ordinance to comply with state law for procuring “professional services”. 

 

BE IT THEREFORE ORDAINED, by the City Council of the City of Jonesboro, Arkansas that:

 

SECTION 1: The term “professional services” shall include and be defined as follows:  Legal Services, Financial Advisory, Architectural, Engineering, Construction Management, Land Surveying, Appraisers, Auctioneers, and Accounting Services.

 

SECTION 2: The Contracting Authority is hereby authorized and instructed to negotiate contracts for “professional services” pursuant to the procedures set out in the provision of ACA § 19-11-801 et seq.

 

SECTION 3: All ordinances and parts of ordinances that are in conflict herewith are hereby repealed to the extent of the conflict.

 

SECTION 4: That there being an immediate need to procure professional services to insure the financial continuity of the City of Jonesboro an emergency is declared to exist and this ordinance shall take effect immediately upon its passage and approval.
