AN ORDINANCE TO AMEND SECTION 15.16.01 (c)  AND ADD  SUBSECTION (g)  TO THE CODE OF ORDINANCES OF THE CITY OF JONESBORO, ARKANSAS FOR THE PURPOSE OF ADOPTING A STREET IMPROVEMENT AGREEMENT FOR USE WITH ENFORCEMENT OF THE SUBDIVISION REGULATIONS AND TO PREVENT PIECE MILL INSTALLATION OF STREET IMPROVEMENTS.

BE IT ORDAINED by the City Council for the City of Jonesboro, Arkansas that:
 
SECTION 1: That Section 15.16.01 (c) is hereby amended to read as follows: The subdivider shall provide permanent six inch (6") concrete curbs with integral concrete gutters or standard rolled curbs and gutters on all streets to the following specifications except as noted in subsection (g) of this ordinance.
 
SECTION 2: That Section 15.16.01 (g) is hereby added to Section 15.16.01. The required subdivision improvements in subsection (c) above shall be installed on all new or existing, unimproved dedicated streets EXCEPT when the subdivision adjoins an existing paved street.  In these circumstances, the subdivider shall not be required to make the improvements but shall be required to enter into a street improvement agreement for future participation in the street improvements.  
 
SECTION 3: That there is hereby adopted by reference a street improvement agreement which carry the form shall number SIA #1, (See Attachment).
 
SECTION 4: All ordinances or parts of ordinances in conflict with this ordinance are hereby repealed to the extent of such conflict.
 
SECTION 5: This ordinance, being necessary for the preservation of the public peace, health and safety, is hereby declared to be an emergency and this ordinance shall take effect and be in full force from and after its passage and approval.
