AN ORDINANCE TO AMEND SECTION 14.08.02, KNOWN AS THE R-1 RESIDENTIAL ZONING DISTRICT, OF THE CODE OF ORDINANCES OF THE CITY OF JONESBORO TO ALLOW PRIVATE SCHOOLS.

BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas:
SECTION 1: That Section 14.08.02 (A) (3) of the Code of Ordinances of the City of Jonesboro be amended as follows:
(A) (3) COMMUNITY USES. Public parks, playgrounds and open spaces; churches, public schools and utility or governmental facilities. Private, not for profit (501(C)3 or 509(A)), non-vocational, non-therapeutic, non-rehabilitative, non-recreational teaching institutions providing primary or secondary education, which may include preschool or kindergarten, with the intent of providing an education.
SECTION 2: It is found and declared by the City Council that the current uses allowed by this ordinance unduly restrict educational opportunity and that, therefore, an emergency exists and this ordinance, being necessary for the preservation of the public peace, health and safety, shall take effect from and after its passage and approval.
