RESOLUTION TO PERMIT ESTABLISHMENT OF UTILITY LINES ON THE RIGHT-OF-WAY ON HOUGHTON STREET

body

WHEREAS, certain difficulties have arisen due to the lack of formal dedication of a portion of East Washington Avenue from Houghton Street east for a distance of 264.2 feet where such street crosses property owned by Claude G. Kirksey, and

WHEREAS, the Street Committee of the City Council has reported to the Council that as a result of negotiation with said owner, it is possible to obtain dedication of additional right-of-way of 34.6 feet, provided the City, with the consent of the City Water & Light Plant and Arkansas-Louisiana Gas Company, will bind itself to contain conditions regarding the use of such right-of-way, and

WHEREAS, it appears to be in the best interests of the City of Jonesboro for the use and benefit of the public to settle the question of right-of-way by acceptance of these conditions;

NOW, THEREFORE, be it resolved, by the City Council of the City of Jonesboro, that in consideration of the granting of a Dedication Deed by Claude G. Kirksey and wife of an area for street right-of-way purposes described above, the City does hereby agree to permit the establishment of utility lines on such right-of-way only as follows: sewer line generally in the center thereof; main gas line on the North side thereof, and main water lines on the South side of the full right-of-way in the area previously dedicated by Madie Leary, which area is eight feet in width on the East and 7.6 feet in width on the West end, the total dedicated area hereby to be 42.2 feet on the West; beginning at Houghton Street and running East a distance of 264.2 feet and 42.6 feet on the East.
