AN ORDINANCE TO VACATE AND ABANDON A UTILITY EASEMENT

BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas, that:
SECTION 1: The City of Jonesboro, Arkansas, hereby releases, vacates and abandons all of its rights, together with the rights of the public generally, in and to the 15' utility easement designated as follows, and that the existing easement of record be relocated as shown on the proposed replat as indicated below:
Fifteen foot (15') utility easement along the North Sides of Lots 1, 2, and 3, Block "M" and the West Side of Lots 6 and 7, Block "M", RidgePointe Country Club - Phase III, and they be relocated to the rear lot lines as shown on the proposed replat.
SECTION 2: A copy of the Ordinance certified by the City Clerk shall be filed in the office of the recorder of Craighead County, Arkansas and shall be filed in the deed records of such office.
SECTION 3: The City Council of the City of Jonesboro, Arkansas finds and declares that the above utility easement is not necessary for the general benefit and welfare of the public; that the owners of all the property abutting the above easement are in favor of the closure and vacation of the above easement and that therefore an emergency is declared to exist and this Ordinance shall take effect and be in full force from and after its passage and approval.
