RESOLUTION TO CONVEY PROPERTY TO CITY WATER AND LIGHT PLANT TO INSTALL A WELL
body
WHEREAS, Turtle Creek Partners, LLC conveyed to the City of Jonesboro, Arkansas Lots 1 through 12 Block B Viking Addition to the City of Jonesboro, Arkansas by Warranty Deed dated October 13, 2004; and,
WHEREAS, City Water and Light of Jonesboro, Arkansas acquired a triangular piece of land from Turtle Creek Partners, LLC containing .515 acres located North of its existing electrical substation and City Water and Light intends to install a well on this tract of land, and,
WHEREAS, pursuant to Arkansas Department of Health regulations City Water and Light must own in fee simple all land within a 100 foot radius of the well-head; and,
WHEREAS, City Water and Light has located its well-head on approximately a 15 by 15 tract of land which will be located on the West bank of the relocated Turtle Creek drainage ditch; and,
WHEREAS, City Water and Light of Jonesboro, Arkansas has requested that the City of Jonesboro convey to City Water and Light Plant of Jonesboro, Arkansas Lots 8, 9, 10, and 11 in Block B Viking Addition to the City of Jonesboro, Arkansas subject to existing easements and subject to a reservation by the City of Jonesboro of a permanent drainage easement over Lots 8, 9, 10, and 11 in Block B Viking Addition to the City of Jonesboro, Arkansas.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Jonesboro, Arkansas that the City of Jonesboro, Arkansas agrees to convey to City Water and Light Plant of Jonesboro, Arkansas an Arkansas Municipal Improvement District Lots 8, 9, 10, and 11 in Block B of Viking Addition to the City of Jonesboro, Arkansas subject to existing easements and subject to a reservation by the City of Jonesboro of a permanent drainage easement over Lots 8, 9, 10, and 11 less and except a tract containing approximately 358 square feet and more particularly described in the Quitclaim for the sum of Five Hundred Dollars ($500.00)...
