AN ORDINANCE DECLARING THE DUTIES AND SALARY OF THE CITY CLERK, AND ESTABLISHING THE ELECTED POSITION AS A FULL TIME POSITION (NOTE: THIS ORDINANCE WAS AMENDED BY ORD-93:787 ON APRIL 5, 1993)

WHEREAS, Arkansas Code Annotated, Section 14-43-506 provides that the City Clerk in cities of the first class shall have custody of all the laws and ordinances of the City and shall keep a regular and correct journal of the proceedings of the City Council.

WHEREAS, Arkansas Code Annotated, Section 14-43-406, maintains that each City Council shall provide the City Clerk's office with the official City Seal and the seal shall be affixed to all transcripts, orders, by-laws, proclamations, certificates, ordinances, and resolutions for proper authentication.

WHEREAS, Arkansas Code Annotated, Section 14-43-506 and 14-43-508, provide that the City Clerk shall give a financial report quarterly of the City's finances, to the City Council in open session.

WHEREAS, Arkansas Code Annotated, Section 24-11-813 declares it to be the duty of the City Clerk to file on or before December 31st of each year a report with the Arkansas Fire and Police Pension Review Board of the number of firefighters with the names, dates or appointment, dates of retirement, birth dates, amounts of pensions paid, and other information as required by the pension review board.

WHEREAS, the Arkansas Freedom of Information Act requires reasonable access to public records and reasonable comforts and facilities for the full exercise of the right to inspect and copy those records shall not be denied to any citizen and except as otherwise, all public records shall be open to inspection and copying by any citizen of the State of Arkansas during the regular business hours of the custodian of the records. Also, proper notification to the media of any and all regular, called or public meetings is required.
