AN ORDINANCE TO WAIVE COMPETITIVE BIDDING AND AUTHORIZE PURCHASE OF A 2008 GRADALL XL3300 FROM EQUIPMENT CONNECTION.

WHEREAS, the Street Department of the City of Jonesboro needs to purchase a Gradall XL3300; and
WHEREAS, that said equipment may be purchased from Equipment Connection of Jonesboro, Arkansas for the sum of $195,000.00 to be paid from the Street Department budget; and
WHEREAS, said equipment may be purchased used with twenty-two (22) hours, along with a 12 month power train and hydraulic warranty at a substantial savings.
BE IT ORDAINED by the City Council for the City of Jonesboro, Arkansas that:
SECTION ONE: That the City of Jonesboro, Arkansas is hereby authorized to purchase a 2008 Gradall XL3300 w/22 hours, SN 3300000681 with 12 month power train & hydraulic from Equipment Connection for $195,000.00.
SECTION TWO: That the City Council in accord with the terms of A.C.A. Section 14-58-302 hereby waives the requirement of competitive bidding and directs the Purchasing Agent to issue a purchase order for the above described for the price set forth in Section One above.
SECTION THREE: It is further found that due to immediate need to acquire this equipment an emergency is declared to exist and this ordinance being necessary for the preservation of the public, peace, health and safety, it shall take effect from and after its passage and approval.
SECTION FOUR: The Mayor and City Clerk are hereby authorized to enter into this contract and to execute all documents necessary.
