RESOLUTION TO SET A PUBLIC HEARING TO ABANDON AN UNIMPROVED PORTION OF A TEN FOOT UTILITY EASEMENT AS REQUESTED BY JAMES WILLETT

WHEREAS, the property owner/s have filed a petition with the City Clerk of the City of Jonesboro, Arkansas, requesting that unimproved portions of a ten foot (10') utility easement described as follows;
PART OF LOT 6 OF A RE-PLAT OF MERRYMAN RE-PLAT AND PART OF LOT 5 OF THE RE-PLAT OF THE SOUTH HALF OF LOT 2 OF LARID'S SURVEY OF THE NORTH HALF OF THE NORTHWEST QUARTER OF THE NORTHEAST QUARTER OF SECTION 28, TOWNSHIP 14 NORTH, RANGE 4 EAST ALL BEING IN JONESBORO, CRAIGHEAD COUNTY, ARKANSAS, BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS:
BEGIN AT THE SOUTHWEST CORNER OF LOT 5 OF THE REPLAT OF THE SOUTH HALF OF LOT 2 OF LAIRD'S SURVEY OF THE NORTH HALF OF THE NORTHWEST QUARTER OF THE NORTHEAST QUARTER OF SECTION 28, TOWNSHIP 14 NORTH, RANGE 4 EAST, JONESBORO, CRAIGHEAD COUNTY, ARKANSAS; THENCE NORTH 0°07'47" EAST ALONG THE WEST LINE OF LOT 5 AFORESAID, 113.76 FEET TO THE POINT OF BEGINNING PROPER; THENCE CONTINUE NORTH 0°07'47" EAST ALONG SAID WEST LINE AND THE WEST LINE OF LOT 6 OF A RE-PLAT OF MERRYMAN RE-PLAT TO THE CITY OF JONESBORO, CRAIGHEAD COUNTY, ARKANSAS, 10.00 FEET; THENCE NORTH 89°12'50" EAST 72.50 FEET TO THE EAST LINE OF LOT 6 OF A RE-PLAT OF MERRYMAN RE-PLAT AFORESAID; THENCE SOUTH 0°07'47" WEST ALONG THE EAST LOT LINE, OF LOT 5 AND LOT 6 AFORESAID 10.00 FEET; THENCE SOUTH 89°12'50" WEST 72.50 FEET TO THE POINT OF BEGINNING PROPER.
be vacated and abandoned; AND
WHEREAS, the petition has been presented to the City Council of the City of Jonesboro, Arkansas; AND
WHEREAS, Arkansas Statute Annotated 19-3814 requires two week public notice before the above utility easement can be vacated and abandoned;
