AN ORDINANCE VACATING AND ABANDONING ALL OF THAT PORTION OF LARKWOOD DRIVE EXTENDING FROM CREEK DRIVE TO FOREST HOME ROAD IN CREEK PLACE SUBDIVISION

WHEREAS, the Jonesboro City Council at its regular meeting on March 18, 2014, heard the Petition of Centennial Bank, owner of all of the property abutting the portion of Larkwood Drive requested to be vacated and abandoned; and
WHEREAS, after notice required by law was published, the City Council at its regular meeting on March 18, 2014, heard and duly considered the Petition as well as all persons desiring to be heard in connection with this matter; and
WHEREAS, the respective utilities have consented to said abandonment; and
WHEREAS, the abandonment of said portion of Larkwood Drive right-of-way will not adversely affect the City of Jonesboro, it is no longer needed for public right-of-way, and it would be in the best interests of all parties concerned that the street be vacated and abandoned.
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas, that:
SECTION 1. The City of Jonesboro, Arkansas, pursuant to Ark. Code Ann. § 14-301-301, et seq. and Ark. Code Ann. §14-54-104 hereby releases, vacates and abandons all of its rights, together with the rights of the public generally, in and to that portion of Larkwood Drive extending from Creek Drive to Forest Home Road, as shown on the recorded plat of Creek Place Subdivision in the City of Jonesboro and on the attached Exhibit “A”, and that the same be, and is hereby vacated and abandoned, subject to a twenty (20) foot sewer easement, in favor of City Water & Light Plant of the City of Jonesboro, ten (10) feet either side of the sanitary sewer main as constructed running north and south along the portion of the street to be abandoned.
SECTION 2. A copy of this Ordinance duly certified by the City Clerk of the City of Jonesboro, Arkansas, shall be recorded in the office of the Circuit Clerk and Ex-Officio Recorder of C...
