AN ORDINANCE APPROVING THE PURCHASE OF AN EXCAVATOR FOR THE STREET DEPARTMENT, APPROPRIATING FUNDS, AND DECLARING AN EMERGENCY

WHEREAS, the Excavator currently in use by the street department is no longer serviceable and repair parts are not obtainable; and
WHEREAS, there is an urgent need to secure a new Excavator to continue regular work at street department locations; and
WHEREAS, bids for the purchase of a new Excavator have been taken, Bid Number 2004:53, with the low bid meeting specifications of $150,900.00 including trade-in of the Samsung SE350LC2 being received from Hugg & Hall Equipment Company located in Little Rock, Ar.
NOW THEREFORE, BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas that:
SECTION 1: The Mayor is hereby authorized to accept the bid from Hugg & Hall.
SECTION 2: There is hereby appropriated the sum of $155,740.00 from the unappropriated balance of City Sales Tax Funds to the street department fixed asset line item for the purchase of the Excavator.
SECTION 3: The City Council further finds and declares that an emergency exists and this Ordinance being necessary for the preservation of the public peace, health and safety, this Ordinance shall take effect and be in full force and effect from and after its passage and approval.
