AN ORDINANCE TO WAIVE COMPETITIVE BIDDING AND AUTHORIZE PURCHASE OF A USED RUBBER TIRE EXCAVATOR FROM BARTON EQUIPMENT COMPANY FOR THE CITY OF JONESBORO AND FOR OTHER PURPOSES.

BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas:
SECTION 1: That the Street Department needs to purchase the following equipment - Used Rubber Tire Excavator.
SECTION 2: That such equipment may be purchased from Barton Equipment Company, Jonesboro, Arkansas for the sum of $77,000.00 total, with Barton Equipment Company agreeing to give a one year warranty on the power train.
SECTION 3: That the City Council, in accord with the terms of A.C.A. 14-58-302 (2) (B) hereby waives the requirement of competitive bidding and directs the Purchasing Officer to purchase the above described work for the price set forth in Section 2 above. Said amount shall be paid by money from the Fixed Assets line item in the Street Department budget.
SECTION 4: It is further found that due to the immediate need to acquire the above equipment, an emergency is declared to exist and this ordinance being necessary for the preservation of the public peace, health and safety shall take effect from and after its approval.
