AN ORDINANCE TO VACATE AND ABANDON A 50' DRAINAGE EASEMENT LOCATED 1/2 MILE SOUTH OF HIGHLAND DRIVE, EAST OF QUALITY WAY

BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas, that:
SECTION 1: The City of Jonesboro, Arkansas, hereby releases, vacates and abandons all of its rights, together with the rights of the public generally, in and to the drainage easement designated as follows:
A 50' drainage easement in the Craighead Technology Park located on the south side of Highland Drive (Hwy. 18) and east of Quality Way, more particularly described as beginning at the Southwest corner of the NW 1/4, SE 1/4 of Section 28, T14N, R5E; thence S87°24'07" W along the 40 acre line 581.68' to the east right of way line of Quality Way; thence N01°33'58" W along said right of way line 1279.95' to the south line of an existing drainage easement, the point of beginning proper; thence N01°33'59" W along the east right of way line of Quality Way 50.0' to the north line of an existing drainage easement; thence N87°20'09 E along said easement line 1893.99' to the 40 acre line; thence S01°36'56" W along said 40 acre line 25.0' to the Northeast corner of the NW 1/4, SE 1/4; thence S01°36'56" E along the 40 acre line 25.0' to the south line of an existing drainage easement; thence S87°20'09" W along said south line 1894.03; to the point of beginning proper, containing 2.17 acres, more or less, subject to all rights of way and easements of record.
SECTION 2: A copy of the ordinance certified by the City Clerk shall be filed in the office of the Recorder of Craighead County, Arkansas and shall be filed in the Deed Records of such office.
SECTION 3: The City Council of the City of Jonesboro, Arkansas finds and declares that the above drainage easement is not necessary for the general benefit and welfare of the public; that the owners of all the property abutting the above drainage easement are in favor of the closure and vacation of the above drainage eas...
