BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JONESBORO, ARKANSAS:

SECTION 1: Ordinance Number 14.44.05(b) providing for change in district boundary shall be amended as recommended by the Metropolitan Area Planning Commission at a regularly scheduled meeting held on April 13, 2004 as item number (4)RZ04-5.

SECTION 2: The Metropolitan Area Planning Commission recommended that 12.25 acres located on a part of the Northeast ¼, Southeast ¼, Section 21, T14N, R4E, generally located on the North side of Highland Drive and East of Turtle Creek Ditch be rezoned from R-2 Multi-family low density district to C-3, General commercial district.

SECTION 3: The legal description of this property is as follows:

Part of the Northeast quarter of the South half of the Southeast quarter of Section 21, Township 14 North, Range 4 East, Craighead County, Arkansas being more particularly described as follows:

Beginning at the Northeast corner of the South half of the Southeast quarter of Section 21, Township 14 North, Range 4 East, Craighead County, Arkansas: then South 00°00?00' East along the East line of the South half of the Southeast quarter of Section 21, 867.17 feet; then North 89°59?15' West 232.29 feet; then South 28°29?28' East 443.35 feet to a point lying on the North right of way of Highland Drive; then South 88°51?55' West along said right of way 131.61 feet to the West bank of Turtle Creek; then North 26°38?00' West along the West bank of Turtle Creek 1,390.39 feet to the North line of the South half of the Southeast quarter of Section 21; then North 88°46?58' East along the North line 775.87 feet to the point of beginning containing 533,616 square feet or 12.25 acres subject to easements, restrictions, reservations, and right of ways of record.
