The Jonesboro City Council met at 4:30 p.m. Present were the Mayor, City Clerk, City Attorney and the following council members: Vance, Wise, Rega, Evans, Province, Kelton, Roddy and Harpole. A full quorum were in attendance.

 

The meeting was called for the purpose of adopting a resolution urging the defeat of a pending House Bill 1726, “Private Property Protection Act”. Mayor Brodell and other council members wanted the citizens of Jonesboro to be advised of the serious threat Bill 1726 will have to the continuation of any type of local land use planning or zoning program. Bill 1726 does not include condemnation situations only regulatory land use. If Bill 1726 passed, compensation would be paid to any citizen who could convince a jury that he or she suffered a 10% loss due to any governmental regulatory land use decision. The Council expressed concern over protecting Jonesboro’s ability to have orderly growth and locally adopted land use regulations.

 

Mr. Robert Rees, a land developer, spoke in favor of House Bill 1726. Mr. Rees stated House Bill 1726 would prevent governmental agencies from taking property (easements) without compensating the land owner.

 

Councilman Vance moved, seconded by Councilman Harpole, for the adoption of the resolution. A roll call vote was taken resulting in all council members present voting aye. Those members voting aye were: Vance, Wise, Evans, Rega, Province, Kelton, Roddy and Harpole. The resolution was given the number 1995:08.
