RESOLUTION TO VACATE AND ABANDON PART OF AN ALLEY IN BLOCK F OF THE ORIGINAL SURVEY OF THE CITY OF JONESBORO, ARKANSAS

WHEREAS, all property owners adjacent to the South 90 feet of the alley, which runs North and South across Block "F" of the Original Survey of the City of Jonesboro, Craighead County, Arkansas, have requested that such 90 foot portion be closed and abandoned as an alley, and
WHEREAS, the City Council of the City of Jonesboro, Arkansas, as a City of the first class, has found and determined that such 90 foot portion of such alley is not needed for highway purposes and that the welfare of the City of Jonesboro will be enhanced and promoted by the closing and abandoning of such portion of such alley, and
WHEREAS, the Utility Companies having utility lines or utility easements in such portion of such alley have agreed to the closing and abandoning such portion of such alley:
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Jonesboro that the said South 90 feet of the alley, which runs North, and South across Block "F" of the Original Survey of the City of Jonesboro, Craighead County, Arkansas, is hereby closed and abandoned as an alley, pursuant to the authority and provisions of Section 19-3817 of the Arkansas Statutes Annotated, and that the Mayor and City Clerk are authorized and directed to join in, on behalf of the City of Jonesboro, a written Agreement, to be executed by all property owners adjacent to such portion of such alley and the Utility Companies having utility lines or utility easements in such portion of such alley, to close and abandon such portion of such alley, and to take all action necessary, on behalf of the City of Jonesboro, to close and abandon such portion of such alley in accordance with the authority contained in Section 19-3817 of the Arkansas Statutes Annotated.
