Minutes of the August 12, 1997, meeting were approved as submitted.

#1 RZ97-34 The Humane Society, Richard Wang, requested approval of rezoning from Residential R-1 to Commercial C-3 for 2.37 acres located on the north side of Matthews Avenue, west of Strawfloor Drive.

Attorney Jim Lyons represented the Humane Society. Questions were answered concerning indoor\outdoor kennels, and an indoor facility for night use. They have received approval from the State Health Department on the septic system. Types of sound absorbing materials were discussed.

Mark Saddler spoke in opposition to the proposal, in particular, odor and noise. He also believes this should be in an industrial area, not residential.

Ruth Coggin spoke for the Humane Society, stating they had cared for more than 2000 animals last year. The planned improvements, a $300,000 structure with indoor kennels and runs, will improve the quality of life in the area for the animals and the residents.

Ms. Shaw moved to recommend approval of the rezoning to the City Council subject to site plan approval prior to development and street dedications as required by MATA. Mr. Little seconded, four voted aye, three no, Chair voted aye, REQUEST APPROVED WITH STIPULATIONS.

#2 RZ97-35 Jim Lackey requested approval of rezoning from Residential R-1 to Commercial C-3 for .99 acre located at 4114 Forest Hill Road.

It was noted that this was the site of Ellis Machine Shop for many years. Mr. Lackey will be totally remodeling the place, cleaning the premises and making many improvements to the property. Mr. Damron made a motion to recommend approval to the City Council, seconded by Dr. Beadles. Six voted aye, 1 no, REQUEST APPROVED.
