AN ORDINANCE TO WAIVE COMPETITIVE BIDDING AND AUTHORIZE PURCHASE OF SPECIAL STREET SEALING WORK.

BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas:
SECTION 1: That the Street Department needs to purchase CRS2 Asphalt, covered with Class number 1 Limestone Chips to seal approximately 91,000 square yards of street surface, with the contractor providing all materials, equipment and labor to apply the materials where directed by the City in accordance with Division 400, Asphalt Pavements, of the Arkansas Highway and Transportation Department's Standard Specifications for Highway Construction.
SECTION 2: That such street sealing work may be purchased from Baughn Construction Company, Inc., East First Street, Tuckerman, Arkansas 72473, for a unit price of Fifty-Five Cents ($0.55) a square yard for a sum of Fifty Thousand One Hundred Dollars ($50.100.00) total.
SECTION 3: That the City of Jonesboro shall be responsible for preparing the streets in advance of contract work and for providing traffic control during the operation with the contractor notifying the Public Works Director at least two (2) weeks prior to commencing the operation.
SECTION 4: That the City Council in accord with the terms of A.C.A. 14-58-302 (2B) hereby waives the requirement of competitive bidding and directs the Purchasing Officer to purchase the above described work for the price set forth above. Said amount shall be paid from the Street Contracts line item in the Street Department budget.
SECTION 5: Whereas, it found that Baughn Construction Company, Inc., is the sole known source of the equipment to place the CRS2 Asphalt and Class #1 Limestone Chips and that the conditions of many City streets are such that the safety of the citizens of Jonesboro may be in jeopardy, an emergency is declared to exist and this ordinance being necessary for the preservation of the public peace, health and safety shall take effect from and after its passage and approval.
