AN ORDINANCE AMENDING THE JONESBORO CODE OF ORDINANCES ESTABLISHING A VACANCY POLICY FOR CERTAIN CITY BOARDS AND COMMISSIONS

WHEREAS, the Mayor is required by law to recommend to the City Council the appointment of members to certain city boards and commissions; and

 

WHEREAS, as many as eight city board and commission members’ terms have expired on various entities such as the Airport Commission, the Northeast Arkansas Industrial Development Commission, and the Jonesboro Urban Renewal and Housing Authority with at least three of these terms expiring over one and one-half years ago; and

 

WHEREAS, it is the desire of the City Council for the Mayor to recommend appointments and/or reappointments for these vacant positions in a timely manner to enable these city boards and commission to operate in an efficient manner and to enable the City to maintain accurate records of the city boards and commissions membership and terms.

 

NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JONESBORO, ARKANSAS that the Jonesboro Code of Ordinances, Section 2.20.15, is hereby amended to read as follows

 

Section 1. Add Subsection (C) to be entitled Vacancy Policy for Boards and Commissions, and shall read:  In cases in which this ordinance is not in conflict with state or federal law, any city board or commission position which term has expired for a period longer than 60 days shall be declared vacant.

 

Section 2. The provisions of this ordinance are hereby declared to be severable and if any section, phrase or provision shall be declared or held invalid, each invalidity shall not affect the remainder of the sections, phrases or provisions.
