AN ORDINANCE TO VACATE AND ABANDON A CERTAIN PORTION OF AN ALLEY IN BLOCK 3 OF GREGG & HOUGHTON’S SUBDIVISION OF KITCHEN PLACE ADDITION TO THE CITY OF JONESBORO

WHEREAS, a petition was duly filed with the City Clerk of the City of Jonesboro on May 20, 1957, asking the City Council to vacate and abandon all that portion of an alley in Block 3 or Gregg & Houghton’s Sub-Division of Kitchen’s Place Addition, as herein below more particularly described, and as same appears on the plat in deed record book 33 page 169 in the Office of the Circuit Clerk and Recorder at Jonesboro, Arkansas, described as follows:
An alley 15 feet wide by 600 feet long running east and west through Block 3 of Gregg & Houghton’s Sub-Division of Kitchen’s Place Addition, being bounded on the North by lots 1 through 12 inclusive and on the south by lots 13 through 21 inclusive.
WHEREAS, after due notice as required by law, the City Council has at the time and place mentioned in said notice, heard all persons desiring to be heard on the question and has ascertained that the alley herein above described has heretofore been dedicated to the public use as an alley; and that same has not been actually used by the public generally for a period of at least five years subsequent to the filing of the plat; and that all the owners of the property abutting to that portion of the alley to be vacated have filed with City Council their written consent to such abandonment; and that public interest and welfare will not be adversely affected by the abandonment.
NOW, THEREFORE, BE IT ORDAINED, by the City Council of the City of Jonesboro:
SECTION 1: The City of Jonesboro hereby releases, vacates and abandons all its rights, together with the rights of the public generally, in and to the alley above described.
SECTION 2: A copy of this ordinance duly certified by City Clerk shall be filed in the office of the Recorder of Craighead County and recorded.
