AN ORDINANCE ABANDONING AN ALLEY LOCATED IN THE CITY OF JONESBORO, ARKANSAS

WHEREAS, the City Council at its regular meeting hearing the request of to abandon an alley described as follows: Part of Lot B of J. T. Barr first Subdivision to the City of Jonesboro, Arkansas, as recorded in Book #158, Page #97 in the office of the Circuit Court Clerk and Ex-Officio recorder being more particularly described as follows: Begin at the Northeast corner of Lot B of J.T. Barr First Subdivision to the City of Jonesboro, Arkansas; thence South 0°54'43" West 20.20 feet to the point of beginning proper; thence continue South 0°54'43" West 20.00 feet; thence South 89°53'53" West 75.00 feet; thence North 0°54'43" East 20.00feet; thence North 89°53'53" East 75.00 feet to the point of beginning proper, containing 1500 Square feet.

WHEREAS, the City Council held a public hearing and heard all persons desiring to be heard in connection with this matter; and

WHEREAS, the abandonment of said alley would not affect the use of and would be in the best interest of all parties concerned.

NOW, THEREFORE, BE IT ORDAINED by the City Council for the City of Jonesboro, Arkansas, that:

SECTION 1: The City of Jonesboro, Arkansas, hereby vacates and abandons all of its rights, together with the right of the public generally, in and to a portion of the alley designated above in this ordinance.

SECTION 2: A copy of the Ordinance duly certified by the City Clerk shall be filed in the office of the recorder of the county and recorded in the deed records of Craighead County.

SECTION 3: The closing, vacating and abandonment by the City of its rights and the rights of the public generally in the above described portion of the easement is in the public interest and will promote the public peace and welfare. And further, the City Council finds that an emergency exists and this ordinance being necessary for the protection and promotion of the public health, welfare and safety, the same ...
