AN ORDINANCE TO AMEND SECTION 9.08.02 ENTITLED "APPLICATION FOR PERMIT" OF THE JONESBORO CODE OF ORDINANCES, TO ESTABLISH AN INSPECTION FEE ONLY FOR ALL PROPERTIES AND FOR OTHER PURPOSES (NOTE: THIS ORDINANCE WAS AMENDED BY ORD-98:1709 ON JANUARY 19, 1998; ORD-09:096 ON NOVEMBER 17, 2009)

WHEREAS, the Street and Inspection Committees for the City of Jonesboro, have reviewed the installation of driveways and determined improper installation has caused drainage problems and a deterioration of  adjoining  streets; AND
 
WHEREAS, the committees have determined proper installation of driveways is necessary to assure appropriate drainage and preserve streets within Jonesboro, and inspections are needed as required by Section 9.08 of the Jonesboro Code of Ordinances; AND
 
WHEREAS, an inspection fee is necessary to defray the cost of making such inspections.
 
NOW, THEREFORE BE IT ORDAINED by the City Council for the City of Jonesboro, Arkansas that Section 9.08.02, entitled "Application for Permit" be amended by adding the following:
 
SECTION 1: An inspection fee shall be charged with the issuance of a building permit for new construction for each separate driveway and for existing driveways.
 
SECTION 2: The inspection cost shall be set by the Inspection Department at a flat rate to cover expenses occurring from such inspections.
 
SECTION 3: The inspection cost shall be collected by the City Collector at the time of issuance of a building permit.  Failure to pay the inspection fee shall result in the building permit not being granted.
 
SECTION 4: All ordinances or parts of ordinances in conflict with this ordinance are hereby repealed to the extent of such conflict.
 
SECTION 5: This ordinance, being necessary for the preservation of the public peace, health and safety, shall take effect 90 days after its passage and approval.
