AN ORDINANCE TO AMEND ORDINANCE NO. 1266, THE SAME BEING AND ORDINANCE PRESCRIBING CERTAIN RULES AND REGULATIONS WITH RESPECT TO THE CARE AND KEEPING OF DOGS WITHIN THE CITY OF JONESBORO; REQUIRING DOGS TO BE PLACED ON A LEASH OR CONFINED WITHIN A YARD, BUILDING, OR OTHER ENCLOSURE AND FOR OTHER PURPOSES (NOTE: THIS ORDINANCE WAS AMENDED BY ORD-88:1358 ON JUNE 6, 1988)

BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas that Ordinance 1266, amended as follows:
Section 1: Section 11 of Ordinance #1266 is amended as follows:
Any person owning, possessing or keeping a dog which has been allowed to run at large and which has been impounded may retrieve such dog from the City pound by a payment of a fee of $25.00 if the dog is currently vaccinated as required by law or said person may retrieve and reclaim such dog which is not currently vaccinated by payment of a fee of $30.00 The burden of proof to the vaccination of the dog shall be upon the party attempting to claim the dog from the Humane Officer under this ordinance.
Section 2: Any person owning, possessing or keeping a dog which has been allowed to run at large within the City of Jonesboro, Arkansas, shall be deemed guilty of a misdemeanor and shall upon conviction for the first offense be subject to a fine of not more than $10.00; if that same person is convicted of allowing a dog to run loose within the City of Jonesboro a second time said person shall be subject to a fine of not more than $25.00; if a person is convicted of a third offense of allowing a dog to run loose within the City of Jonesboro, that party shall be subject to a fine of not more than $50.00. Each subsequent offense shall constitute a fine of $100.00. The fine shall be in addition to all charges imposed upon said party in claiming and retrieving such dog from the City pound.
Section 3: All ordinance and/or parts of ordinances in conflict herewith are hereby repealed to the extent of such conflict.
