A RESOLUTION TO THE CITY OF JONESBORO, ARKANSAS TO ADOPT PERMANENT LAND USE RESTRICTION FOR THE FORMER STRAWFLOOR ROAD CLASS 4 LANDFILL

WHEREAS, the City of Jonesboro desires to close the Strawfloor Road Class 4 Landfill;
WHEREAS, the Arkansas Department of Environmental Quality (ADEQ) requires a permanent land use restriction for the closure of the Strawfloor Road Class 4 Landfill;
WHEREAS, the City of Jonesboro, Arkansas desires to adopt a declaration of Permanent Land Use Restriction for the closure of the Strawfloor Road Class 4 Landfill described below:
A part of the south half of the southeast quarter of Section 22, Township 14 North, Range 3 East, City of Jonesboro, Craighead County, Arkansas, be more particularly described in the attached Permanent Land Use Restriction document;
WHEREAS, the City of Jonesboro, does hereby acknowledge, and gives notice to the Public, pursuant to Act 718 of 1993 of the General Assembly of Arkansas IT SHALL BE UNLAWFUL FOR ANY PERSON, PARTNERSHIP, COMPANY, CORPORATION, OR OTHER ENTITY TO BUILD, ERECT, OR CONSTRUCT ANY HOUSE, HOME, OR BUILDING TO BE USED FOR RESIDENTIAL PURPOSES, UPON THAT PORTION OF THE REAL PROPERTY HEREINABOVE DESCRIBED WHICH WAS PERMITTED UNDER SOLID WASTE PERMIT NUMBER 0304-S3N, AND THE USE OF SAID REAL PROPERTY IS HEREBY SO PERMANENTLY RESTRICTED. FUTURE LAND USES SHALL COMPLY WITH ARKANSAS DEPARTMENT OF ENVIRONMENTAL QUALITY, AND SHALL NOT DISTURB THE INTEGRITY OF THE FINAL COVER SYSTEM, THE LINER SYSTEM, OR ANY OTHER COMPONENTS OF THE CONTAINMENT SYSTEM.
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL FOR THE CITY OF JONESBORO, ARKANSAS THAT:
Section 1: That the City of Jonesboro shall adopt the declaration of Permanent Land Use Restriction required by ADEQ for the closure of the Strawfloor Road Class 4 Landfill described in the attached Permanent Land Use Restriction document; and
