ORDINANCE TO VACATE AND ABANDON AN ALLEY RUNNING SOUTH FROM MAIN STREET OF NETTLETON STATION TO SCHOOL STREET

WHEREAS, a petition was duly filed with the City Council of the City of Jonesboro, Arkansas, on the 2nd day of December, 1963, praying the City Council to vacate and abandon an alley described as:
An alley running South from Main Street of Nettleton Station to School Street, located between Lots Thirty-four (34), Thirty-five (35) and Thirty-six (36) on the West side, and Lots Nineteen (190, Twenty (20) and Twenty-one (21) on the East side of said alley, in Pardew’s Addition to the Town of Nettleton, now Jonesboro, Arkansas, platted and filed for record in the Recorder’s office at Jonesboro, Arkansas, on the 31st day of August, 1894, in Record Book 14, page 4, and
WHEREAS, after due notice as required by law, the City Council has, at the time and place mentioned in the Notice, heard all persons desiring to be heard on the question and has ascertained that the alley or portion thereof, hereinbefore described, has heretofore been dedicated to the public use as an alley herein described; has not been actually used by the public generally for a period of at least five years subsequent to the filing of the plat; that all the owners of property abutting upon the portion of the alley to be vacated above filed with the City Council their written consent to such abandonment; by the abandonment of such alley.
NOW, THEREFORE, be it ordained by the City Council of the City of Jonesboro, Arkansas:
Section 1: The City of Jonesboro, Arkansas, hereby releases, vacates and abandons all its rights, together with the rights of the public generally in and to the alley designated as follows:
