AN ORDINANCE TO AMEND ORDINANCE NO. 954, KNOWN AS THE ZONING ORDINANCE PROVIDING FOR THE CHANGE IN ZONING BOUNDARIES FROM C-4 TO C-3 LOCATED OFF STONE STREET AS REQUESTED BY GEORGE MACE

BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas:

 

SECTION 1: That Ordinance No. 954, known as the Zoning Ordinance of the City of Jonesboro, be amended as recommended by the Metropolitan Area Planning Commission by the change in zoning district boundaries as follows:

 

 From Commercial (C-4) to Commercial (C-3) of property described as follows:

 

Lot One of Kitterman’s  Replat  of  Lots 2,  3,  4  and  5 of  Block “B” of Foxwood Addition,  Jonesboro, Arkansas. (Stone Street / George Mace).

 

SECTION 2: That the following stipulation be included:  When and if the property that  is  rezoned  C-3 is developed, that a fair and reasonable buffer  zone, to be determined by the  adjoining  property owners, City Council, Metropolitan Area Planning Commission, school  officials,  and developers, be constructed  between the C-3 zoning and any and  all property  adjoining, that is not zoned  C-3.

 

SECTION 3: It is found and declared by the City Council that proper use of the tract of land described in this Ordinance is being delayed because of improper zoning and that, therefore, an emergency exists and this Ordinance, being necessary for the preservation of the public peace, health and safety, stall take effect from an after its passage and approval.

 

PASSED AND ADOPTED this 6th day of September, 1988.
