A RESOLUTION TO AMEND RESOLUTION NO. R-EN-073-2008, A CONTRACT WITH ASSOCIATED ENGINEERING AND TESTING LLC TO PROVIDE ENGINEERING SERVICES RELATED TO THE MASTER STREET PLAN

WHEREAS, the City of Jonesboro has entered into a contract with Associated Engineering, LLC to provide services related to the development of a Master Street Plan; and
WHEREAS, the contract declares that the contractor shall complete services in one-hundred-ninety days upon issuance of the notice-to-proceed and not from the date that contract was signed; and
WHEREAS, no notice-to-proceed was issued by the City of Jonesboro resulting in a delay in the commencement of the contract; and
WHEREAS, the Master Street Plan is a substantial document integral to the orderly long range planning and development of the City’s thoroughfare system and subsequently necessitates an appropriate amount of time to prepare; and
WHEREAS, the Master Street Plan will, upon its adoption by the City of Jonesboro, potentially have a significant impact on the City’s infrastructure over the planning period; and
WHEREAS, the contractor and the City both desire to present a Master Street Plan that best reflects and serves the orderly development interests of the citizens of Jonesboro;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL FOR THE CITY OF JONESBORO, ARKANSAS, THAT:
SECTION 1: The time frame for completion of the Master Street Plan shall be extended from 190 days to 290 days from the date that the contract was signed causing the completion date to be March 29, 2009.
SECTION 2: Adoption of this resolution shall retroactively constitute a notice-to-proceed effective from the date that the contract was signed, June 12, 2008.
SECTION 3: The Mayor and the City Clerk are hereby authorized by the City Council for the City of Jonesboro to execute all documents necessary to effectuate this agreement.
