AN ORDINANCE TO ADOPTING BY REFERENCE CHAPTER 8 CONCERNING DOWNTOWN PARKING REPLACING THE DOWNTOWN CODE WITH A REVISED OFFICIAL CODE AND MOVING ENFORCEMENT OF DOWNTOWN IMPROVEMENT DISTRICT PARKING VIOLATIONS TO THE JONESBORO POLICE DEPARTMENT.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JONESBORO, ARKANSAS THAT:

WHEREAS, The City Council hereby determines and declares that the area of downtown Jonesboro within the confines of the downtown improvement district, City of Jonesboro, Arkansas, suffers from inconsistent and inadequate parking regulations. The City Council further hereby determines and declares that the inadequate and inconsistent parking policies create congestion, obstruct the free circulation of traffic, diminish property values, and endanger the health, safety and general welfare of the citizens of Jonesboro, Arkansas, and that the passage of regulations for on-street and off-street parking is necessary to alleviate such conditions, and

WHEREAS, enforcement of parking violations should be handled by the City of Jonesboro Police Department.

WHEREAS, pursuant to ACA 14-55-207, public notice was given of the City’s intent to adopt said code by reference, and advised that three (3) copies of the document were on file and available for public review and examination in the Office of the City Clerk, and

WHEREAS, all comments, views, suggestions and recommendations have been considered and addressed,

SECTION 1: That Chapter 8.44 is herby repealed in it entirety, and amended by the Downtown Parking Code as provided by, Exhibit “A”.

SECTION 2: That in the event any title, subtitle, section subsection, subdivision, paragraph, subparagraph, item, sentence, clause, phrase or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of this ordinance which shall remain in full force and effect as if the portion so declared or adjudged i...
