AN ORDINANCE TO AMEND TITLE 14 OF THE JONESBORO MUNICIPAL CODE KNOWN AS THE ZONING ORDINANCE PROVIDING FOR A CHANGE IN ZONE DISTRICT BOUNDARIES

BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas:

 

SECTION 1: That Title 14 of the Jonesboro Municipal Code known as the Zoning Ordinance of the City of Jonesboro, Arkansas, 00 be amended by the change in zone district boundaries as follows:

 

From I-1, Limited Industrial District, to C-3 L.U.O., General Commercial District with Limited Use Overlay for Recreational Entertainment Indoor Center that land described as follows:

 

A part of the North 1/2 of Section 1, Township 13 North, Range 4 East, Jonesboro, Craighead County, Arkansas being more particularly described as follows:

 

Beginning at the Northeast Corner of Section 1, Township 13 North, Range 4 East: thence, South along the East Line of Section 1 aforesaid, 360.78 feet to the North Right-of-Way Line of United States Highway #63: thence, along said North Right-of-Way Line as follows: N70°18'07"W, 426.18 feet: N58°51'50"W, 203.24 feet: N49°10'42"W, 177.39 feet to the North Line of Section 1, aforesaid: thence, S89°41'01"E, along said North Line, 709.45 feet to the point of beginning.

 

Containing in all 153,220 sq. Ft. or 3.517 acres.

 

Subject to easements, restrictions, reservations and rights-of-way of record.

 

SECTION 2: A building permit shall not be issued for construction of any structure on this tract of land until public water and public sanitary sewer are available to serve this land.

 

SECTION 3: It is found and declared by the City Council that proper use of the tract of land described in this Ordinance is be delayed because of improper zoning and that, therefore, an emergency exists and this Ordinance being necessary for the preservation of the public peace, health and safety, it shall take effect from and after its passage and approval.
